Terms of Service

1. Acceptance of Terms

By accessing or using PerilScore (the "Service"), operated by Peril Score, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PerilScore provides property catastrophe risk scores based on publicly available data and proprietary models. Scores are available via the web application at app.perilscore.com, the REST API, and third-party integrations including the ChatGPT App.

3. No Warranty; Informational Use Only

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. Risk scores are informational estimates derived from statistical models and historical data. They are not a substitute for a professional property inspection, actuarial assessment, or underwriting decision. We make no representation that any score is accurate, complete, or current for any specific property or use case.

4. Limitation of Liability

To the maximum extent permitted by applicable law, Peril Score, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or reliance on the Service, including but not limited to decisions made in connection with property purchase, insurance placement, or disaster preparedness. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

5. ChatGPT App Integration

When you access PerilScore through the ChatGPT App, your use is also subject to OpenAI's terms of service and usage policies. We process property addresses submitted through the ChatGPT App solely to return risk score data. We do not receive your ChatGPT conversation history. The risk scores returned are subject to the same informational limitations described in Section 3 above.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to scrape, reverse-engineer, or systematically extract data from the Service beyond what is permitted by your plan.
  • Resell or redistribute risk scores without a written reseller agreement.
  • Submit addresses in bulk without prior authorization from us.

7. Accounts and Credits

Certain features require an account and consume credits. Credits are non-refundable except as required by applicable law. We reserve the right to modify pricing and credit costs with reasonable notice. We may suspend or terminate accounts that violate these Terms.

8. Intellectual Property

All content, models, and software comprising the Service are the property of Peril Score, LLC or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
