1. Acceptance of Terms
By accessing or using PerilScore (the "Service"), operated by Peril Score, LLC ("we," "us," or "our"), you agree to these Terms of Service. If you use the Service for an organization, you represent that you have authority to accept these Terms for that organization. If you do not agree, do not use the Service.
2. Description of Service
PerilScore provides property-risk intelligence through its web application, reports, APIs, widgets, and third-party integrations including the ChatGPT App and Model Context Protocol (MCP) connectors for Claude and other compatible clients. Features can include catastrophe scores and factors, fire-protection context, property and construction characteristics, COPE data, indicative replacement-cost estimates, building-permit signals, imagery observations, AI-generated summaries, exports, and related workflow tools.
3. Decision Support; Qualified Review Required
PerilScore provides property-risk data and decision-support evidence. It does not approve, decline, bind, quote, price, issue, or determine insurance coverage, and it does not replace an inspection, appraisal, actuarial analysis, carrier rulebook, or licensed professional judgment.
Customers may map structured fields into their own documented eligibility, referral, inspection, pricing, or underwriting logic. The customer remains solely responsible for rule design, testing, source-data verification, avoiding prohibited or discriminatory factors, regulatory and carrier compliance, and qualified professional review before any decision affecting an applicant, insured, or policyholder is finalized or communicated. Do not use PerilScore or AI-generated output as the sole basis for a high-impact insurance decision.
4. Data and Methodology Limitations
Risk scores and premium data are estimates assembled from models and available public, licensed, customer-provided, and third-party sources. Coverage, age, precision, and completeness vary by location and provider. Missing data must not be interpreted as a favorable result.
- Replacement cost: RCV output is an indicative structure-only reconstruction range for insurance-to-value triage. It excludes land and is not market value, actual cash value, an appraisal, a contractor bid, or a carrier cost-manual certification. Review its methodology version, input-completeness label, assumptions, missing inputs, and exclusions. Input completeness is not calibrated estimate accuracy.
- Permit data: third-party permit coverage and matching vary by jurisdiction. "No permits found" is meaningful only when the lookup succeeded within known coverage; it does not prove no work occurred. Reported job values are not verified construction costs.
- Imagery and AI: identified imagery observations and underwriting summaries may be generated with AI and may contain errors or omit relevant facts. Review the underlying evidence and disclose AI involvement when output is communicated to a consumer.
- Citizens/FWUA: Florida wind-only territory metadata is a curated approximation of a January 1, 2002 statutory reference, not an authoritative or binding eligibility determination. Boundary and geocoding uncertainty require review against current official or carrier sources.
5. No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF ACCURACY, COMPLETENESS, CURRENTNESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted access, availability of any provider or feature, or suitability for a specific property, insurance program, or regulatory purpose.
6. Third-Party Clients and MCP Authorization
When you use PerilScore through ChatGPT, Claude, or another client, your use of that client is governed by its terms and policies. Protected MCP tools may require OAuth authorization or another supported credential. You are responsible for reviewing requested scopes, protecting credentials, revoking access that is no longer needed, and ensuring that your prompts and tool inputs are authorized for disclosure to PerilScore and the selected client.
PerilScore receives tool requests rather than unrelated client conversation history. Tool results returned to a third-party client may then be stored or processed by that client under its own terms. Free score-only tools and premium authenticated tools may have different data, usage, and billing behavior.
7. Accounts, Credits, and Premium Operations
Certain features require an account, an eligible plan, or credits. A premium tool that states it consumes a credit may create a saved report and apply usage when invoked. Review the tool description and confirmation shown by your client before running it. Credits are non-refundable except as required by law or expressly stated in applicable commercial terms. We may change pricing or credit costs with reasonable notice and may suspend accounts for nonpayment, abuse, security risk, or violation of these Terms.
8. Acceptable Use
You agree not to:
- Use the Service unlawfully or to make a prohibited, discriminatory, or unreviewed high-impact decision.
- Misrepresent an estimate, AI observation, permit signal, or mapped territory as verified fact or binding eligibility.
- Attempt to bypass authentication, authorization, plan limits, rate limits, or security controls.
- Probe or test the Service outside the responsible-disclosure guidance, or access data belonging to another user or organization.
- Reverse-engineer, scrape, resell, or systematically redistribute data beyond rights granted by your plan and applicable provider terms.
- Submit personal, confidential, or regulated information that is unnecessary or that you lack authority to process.
9. Intellectual Property and Data Rights
The Service, its software, owned models, and presentation are protected by intellectual-property law. Third-party data remains subject to applicable provider rights and restrictions. Your plan grants only the access and internal-use rights expressly described in these Terms or separate commercial terms; it does not grant ownership of underlying provider data or a general right to republish it.
10. Limitation of Liability
To the maximum extent permitted by law, Peril Score, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business, or opportunities arising from use of or reliance on the Service. Our total liability for claims arising from the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so these limits apply only to the extent permitted.
11. Privacy
Our processing of personal information is described in our Privacy Policy. You are responsible for providing any notices and obtaining any permissions required for information you submit on behalf of another person or organization.
12. Changes and Availability
We may update the Service or these Terms as products, laws, and provider relationships change. Material changes will be communicated through the Service, email, or another reasonable channel. Continued use after an updated version takes effect constitutes acceptance to the extent permitted by law.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
